Here is the situation:
I-485 is pending
H1 Visa will expire on July 31, 2009 (extension is being filled now)
AP is pending for 6 months with no end in sight...
No EAD
Need to travel in end of June for a month:
my question is
Can I travel on AP when my H1 petition is pending?? (I do not expect that I will get it before I leave, it took more than 6 months last time). I read in many places that if you apply for H1 petition you cannot leave till it is approved, is that true???

Yes. I-134 is required. Make sure you send copies of all the pages in your passport (including blank ones).

Doing a AR11/Change of address, do I include all these as additional applications
1. MTR number
2. Appeal number
3. Original 485 (denied) for primary applicant
4. Original 485 (denied) for spouse
5. Denied 140 number
or just these

For EB3 case, after receiving the approval for I 140, I know that we have to wait till DOL Proiority Date is current to be able to file for I485.
If we decide to receive the green card in any consulars overseas, can we just go ahead and file the I485 after getting the I140 approval? (without waiting for PD to be current):

yes there most likely will be an RFE asking for her paystubs...looking at the current trends. You might try her stamping H-4 instead. People have a higher rate of success there. For her H-4 stamping, they just might ask for your paystubs....but thats also not a complete guarantee.

What sort of "tricks" are you after.
I think it's fair to say that "learning to use the camera itself" is the easy part. Understanding of how to take good photos is a lifetime ambition for most of us... ;-)
To put it another way, there may well be small tricks like "if you set this up, you can press that button, and you've automatically set it ready for doing X". Which is great. But if you don't know the basic things like: composition, lighting/exposure and control of focus/depth of field, which are the basic photography concepts, then you're barking up the wrong tree fishing for tricks.
So, some tricks are "rule of thirds" and "blur out un-wanted background noise". But that's regardless of the camera you use.

The has to be physically present in the US to apply for 485. If she does not have a passport then she cannot file for 485.

tanyas_21: Amendment processing time is same as normal H1 processing time. Your status is H4 until the H1B amendment (797 w/ I-94) is approved or You re-enter USA after you get your H1B stamped. USCIS usually sends cable to home consulate mentioned in I-129 about the approval of H1B - It is one of the reason, most of the attorneys' recommend people to get it stamped from home consulate. As long as you go with all the paper work, You can get it stamped from Mexico, and I dont see any issues. Do not attempt to get it stamped from Canada unless you have a verifiable US education. I'm getting a visa stamping date in Kolkata embassy but I'm from New Delhi. I dont want to take a chance and wait till the dates in New Delhi embassy are available. Can I schedule interview in Kolkata and later when dates become available in New Delhi change it ? I mean can I change the venue of my appointment ?

Hello all:
Applied for 140 transfer TSC June 2007. Have not heard anything since, I mean absolutely nothing. Is this due to the backlog?? I am starting to get worried as I checked my status and all it says is, the received date and that when there is update they will let us know.
Did any of you apply 140 transfer in TSC around that time? Any news on those? Any case that it could've been lost?
Big question to the experts is, what do I do to make sure they are working on it and my application is in queue.

What do you mean by transfer. You can not transfer I140, you can only port the PD.

They have covered their bases by putting "May" in the headline. "May" increase visas.
There is already a discussion that happened about this on another thread. Please search the forums for the article before starting a new thread.
And for heaven's sake, please dont look for immigration related news in Indian Newspapers. They dont know that congress has two chambers : House and Senate. And they dont know the common basics of legislative process in USA.

I currently have approved EAD, I-140 and waiting for a Visa number to become available. My receipt date for I-485 was July 2nd 2007 and my notice date was September 27th. My employer is closing the IT department in March. Though it has been 180 days since my receipt date, it's not 180 days since my notice date. Will my I-485 processing be impacted when a Visa number becomes available? Also, will it be Ok if I'm out of a job for a short time while I'm looking for my next job? I sincerely appreciate the help and guidance in this matter.

If you are planning to use EAD no problem, but if you are planning to use AC21 with H1B then you need to maintain valid status as specified in your H1B. i.e., if you can mainting the salary specified in your offer letter and if that matches your W2 for the year, then you are ok.
These are my thoughts.

You can use EAD with current employer. I think your company has to do the change your I9 form to EAD. You don't need to inform as you are not changing any company.

I have been with my employer all along.... and prefer to stay with same employer till GC.
I DONT want to apply for my H1 extension since they are asking lot of questions like Contract details etc with RFE's.
My Q is - Can i use EAD with my EXISTING employer or EAD should be used for only NEW employer based on AC21?
If i use EAD with my current employer, should i have to inform uscis(any process involved)?
