WOW I'm sorry to hear this, I was on the same boat so I can understand. There's nothing you can do. Your employer or attorney can try to contact DOL. I filed May 07 as well, they audited and after replying nothing happened for a very long time. And then out of the blue they approved March of 08. My attorney said there's nothing we can do other than wait as they were auditing left and right, specially EB2. Eventhough my attorney send letters requesting updates they never responded.
I guess I was extremly lucky to finally get approved.

To be on safe side, I suggest you first get 3 yr. ext. and then change your job.
"After job change can I use old PD ? Can I apply EB2 perm after changing job ?"
Answer of first question, yes you can use your old PD only if your current employer (old if you change job) does not revoke it.
second answer, you can apply in perm-eb2 with new employer as you now have more exp. (old job).
But still check with another lawyer.

Just wondering if anybody is giving up hopes of GC and switching from H1B to E3D (Dependent of Australian spouse) to take advantage of 2-yr renewable EADs...? How long does it take to get the initial EAD...Continue working without pay (or is there a workaround) while waiting for EAD?....any problems getting visa stamped with a 'yes' for past immigrant petition filed...
7yrs in this country...EB2 PD of 10/07 due to job changes..no 140 yet, no 485...6yrs in same job? no promotions? with 3yr extensions...frustration beyond words...E3D seems to a ray of hope but no idea of complications involved.
Yeah its frustrating everyone waiting for a GC .. I think doing something is better than nothing. Go with your spouse. Who knows things might take a turn for the better.

This is my understanding PERM has no fees to department of labour. Is that right ?

For me EB3 PD date doesn't mean anything because EB2 PD is current. I believed you may retain your PD if you got your I-140 approved.
do you know if you can retain your PD from your eb3 application for your new application..

Arent you allowed to apply for OPT only after you express ur desire to "graduate"?
if that is the case that means you have completed ur studies.
The other option would be enroll for a second MS...and try to go find a job on CPT?
i would not travel out on a OPT...
if you really want to travel...travel when ur F1 is valid.

- I came here in 1998 on F1
- Transferred to H1-B in 2002
- Filed for Labor Cert in 2005 (EB3) in Nevada
- I-140 approved in 2008
- I-485 pending for more then 180 days as of 2008
- EAD valid through 7/10/2009
- Got laid of in Feb 2009
- I got a job as an associate, a consultancy firm on W2 basis on Nov 17th, 2009 in WA
I have not done anything (i.e.informing the USCIS about job change etc.). I have the following questions.
- what documentation is required to be submitted to the USCIS about the new job.
- What kind of documentation is required from the employer vs myself
- When/how soon has this documentation is to be submitted
- When do i need to apply for my renewal of my EAD card
- What documentation is required to be submitted for the EAD renewal from employer vs myself
- Is it advisable to employ the services of an attorney if we run into issues.
- I worked on similar job for very short stints in between, but it was for a few weeks, does it endanger my case in anyway.
Any advice would be greatly appreciated.

You can re-use priority date established on first I-140 for any sub-sequent I-140 filling. As I understand from your post, you have EB3 labor approved and have just filed for I-140 based on it.
Now, parent company wants to transfer you. Generally I would think you should be able to transfer and still have your GC process going if the company indeed is a 'parent company' but seems there is something different here.
As a general rule, as long as your previously approved I-140 remained approved, you can re-use priority date established for that I-140 for any subsequent I-140 petition. The sub-sequent petition can be with any employer, and yes, you would need a new labor to file that new I-140 :)
Try EB1 or EB2 this time :cool:

If you have been in the US for more than 1 year, you are a resident of the US and not any particular state in India. You are free to go to any Consulate in India. Even though I was previously a resident of AP, I have been able to get successful stamping in New Delhi.

I played around with this a bit, and found the solution. The problem occurred when I had "Empty Project." I created a new project "Console Application," and then I was able to "load" the Process class/namespace. Can anyone explain to me why this would happen? I did a few searches online, but didn't find much help...

That's not completely true. There are improvements in UCIS processing. If you check H1 or I-140 processing time 2 years back , it was much worse then. I dont think USCIS processing time is a problem for us right now. Of course it would be nice to have faster service for H1 and I-140 or 485.

I'm in the same boat at NSC. My EAD/AP(Aug 10) got cleared, but I do not know what happened to I485(July 18) appln. I called uscis, they asked me to wait for 90 days. Pls let me know if you nay updates.

There is an RFE on my advance parole. Came to know about it through my online status. I called to know what the RFE is about and I was told that they can't tell me over the phone and it is between the officer and me and that I have to wait to receive the RFE. Has anyone else experienced this ? I filed the RFE myself online.

She will get her EAD even if your priority date retrogresses in the next visa bulletin.
As far as I know, you don't neccessarily need to file EAD with your I-485. Once your I-485 is pending, you can file EAD anytime after that(irrespective of PD movement) but its always better to file them together.
Someone please correct me if I am wrong.

The original labor approval is lost by Attorney, how ever he has the copy of the approval. He says we can file I-140 with copy. Any one has had this situation ? What is your experience doing this ?

Post date is NOT Important. What's important is the "delivered" date. Think about. USCIS can't and is not responsible for postal delays. If one sends a package and somehow it does not get delivered for 14 days, USCIS cannot mark the application received until and when it receives it, period.
Please check before posting untrue statements. So even if your application reaches the uscis on the July 3rd, but uscis enters your application to the system on August 1st, your filed date will be July 3rd. So don't worry. Make sure your package reaches USCIS in July and you will be OK.

Technically, it is the date when LC application is received by USCIS. Most of the time, it is the same as filing date but not always.
